Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the AI Grow Bot website and the AI Grow Bot WhatsApp marketing and automation platform (the "Service") provided by AI Grow Bot ("AiGrowBot", "we", "us" or "our"). By creating an account, subscribing to a plan or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility and your account
- You must be at least 18 years old and use the Service for business purposes. If you accept these Terms on behalf of a business, you confirm that you are authorised to bind that business.
- You must give accurate registration details and keep them up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account, including activity by team members you invite. Tell us immediately at support@aigrowbot.com if you suspect unauthorised access.
2. The Service
AI Grow Bot is a software platform built on the official WhatsApp Business Platform (Cloud API) by Meta. Depending on your plan, it lets you broadcast campaigns, manage a shared team inbox, build chatbot flows, use AI-assisted replies, capture leads and connect third-party tools. Plan limits (such as contacts, campaigns, bots and staff seats) are shown on our pricing page and in your account. We may improve, change or discontinue features, and we will give reasonable notice of any change that materially reduces the Service you have paid for.
3. WhatsApp Business Platform and Meta policies
- Your use of WhatsApp through the Service is also subject to Meta's terms, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy. You must comply with them at all times.
- Message templates are reviewed and approved by Meta. Meta may also set messaging limits, change quality ratings, or restrict or ban phone numbers and accounts. These decisions are made by Meta, and we are not responsible for them.
- We do not charge a fee to help you obtain the WhatsApp Business API.
4. Acceptable use
You agree that you will not use the Service to:
- message anyone who has not opted in to receive WhatsApp messages from you, or continue messaging people who have opted out;
- send spam, misleading content, or content that is unlawful, abusive, defamatory, obscene, or that infringes anyone's rights;
- promote goods or services prohibited by law or by the WhatsApp Commerce Policy;
- collect or process personal data in breach of the Digital Personal Data Protection Act, 2023 or other applicable law;
- attempt to gain unauthorised access to the Service, interfere with its security or performance, or reverse-engineer it;
- resell or sublicense the Service without our written permission.
We may suspend messages, features or accounts that we reasonably believe breach this section, or that put our platform or our standing with Meta at risk.
5. Plans, billing and renewals
- Prices. Plan fees are listed on our pricing page in Indian Rupees (₹). Applicable taxes, such as GST, are charged as required by law.
- Billing period and auto-renewal. Your billing cycle depends on your plan's billing period (for example monthly or yearly) and starts on your subscription activation date. Subscriptions renew automatically unless you turn off auto-renewal before the renewal date. You can see your next billing date in your subscription dashboard.
- Renewal charges. Auto-billing takes place 1 day after your current period ends. For example, if your subscription expires on 15 January, auto-billing will be attempted on 16 January.
- Upgrades. You can upgrade from Subscriptions > Upgrade. Upgrades are prorated, so you pay only the difference for the remaining billing period, and payment is required immediately to activate the upgrade.
- Downgrades. You can downgrade from Subscriptions > Downgrade. Downgrades are processed immediately, and any credit from the price difference is applied to your account for future billing cycles. Features or limits not included in the lower plan stop being available.
- Failed payments. If a payment fails, we will notify you and give you a grace period to update your payment method. Failed payments are logged in your transaction history and you can retry them from your billing dashboard. If payment is still not received after the grace period, we may suspend the Service until it is paid.
- Price changes. We may change plan prices. Changes apply from your next billing cycle, and we will notify you in advance.
6. WhatsApp messaging charges
Meta charges per message delivered through the WhatsApp Business Platform, based on the template category (marketing, utility or authentication) and the recipient's country. These charges are separate from your AI Grow Bot plan fee and are set by Meta, who may change them at any time. Messages you send in reply within the 24-hour Customer Service Window, and utility templates delivered within that window, are not charged. Current rates are listed in our FAQs.
7. Refunds
Subscription fees and messaging charges that have been paid are non-refundable, except where required by law or expressly agreed with us in writing. Credits arising from downgrades are applied to future billing cycles as described in section 5.
8. Your data and privacy
- You keep all rights to the contacts, messages, media and other content you add to the Service ("Customer Content"). You give us permission to host, process and transmit Customer Content only as needed to provide the Service to you.
- For personal data in Customer Content, you are the Data Fiduciary and we act as your Data Processor under the Digital Personal Data Protection Act, 2023. You are responsible for having a lawful basis, including valid consent and WhatsApp opt-in, for the data you upload and the messages you send.
- How we handle personal data is explained in our Privacy Policy.
9. AI features
AI features (such as AI replies, AI assistants and AI training on your content) use third-party AI models, for example from OpenAI or Google. AI-generated output can be inaccurate or incomplete. You are responsible for reviewing and supervising the replies your bots send and for the knowledge you train them with.
10. Third-party services and integrations
The Service connects with third-party services such as Meta, payment gateways, AI providers, Shopify, WooCommerce and webhooks you configure. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability, content or actions.
11. Intellectual property
The Service, including its software, design, logos and content (other than Customer Content), is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, in line with these Terms. Any feedback you give us may be used to improve the Service without obligation to you.
12. Availability and support
We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. The Service may be unavailable during planned maintenance or because of events outside our control, including outages of the WhatsApp Business Platform or other third-party services. Support is available through the channels listed on our Contact page.
13. Suspension and termination
- You can stop using the Service and turn off auto-renewal at any time; your plan stays active until the end of the paid billing period.
- We may suspend or terminate your access, with or without notice, if you breach these Terms or Meta's policies, fail to pay fees, or if required by law or by Meta.
- After termination you may lose access to your account and Customer Content. Please export any data you need before your subscription ends. We delete data in line with our Privacy Policy.
14. Disclaimer
The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular business result, open rate or sales outcome from using the Service.
15. Limitation of liability
To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service will not exceed the fees you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
16. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your Customer Content, your messages, your breach of these Terms or Meta's policies, or your violation of any law or third-party right.
17. Governing law and disputes
These Terms are governed by the laws of India. We encourage you to contact us first so that we can try to resolve any dispute informally. Any dispute that cannot be resolved this way will be subject to the exclusive jurisdiction of the competent courts at the place of our registered office in India.
18. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when they were last changed. If the changes are significant, we will notify you by email or through the Service. Continuing to use the Service after the changes take effect means you accept the updated Terms.
